Chemical Facility Anti-Terrorism Standards (CFATS) Information Collection 1670-0014

CFATS Announcement

As of July 28, 2023, Congress has allowed the statutory authority for the Chemical Facility Anti-Terrorism Standards (CFATS) program (6 CFR Part 27) to expire.

This means that CISA cannot enforce compliance with the CFATS regulations at this time. This includes the collection of information related to the CFATS regulation. Therefore, CISA is currently not collecting information under the CFATS Information Collection, OMB Control Number 1670-0014. If you have further questions, please contact us at CFATS@hq.dhs.gov.

CISA encourages facilities to maintain security measures. CISA’s voluntary ChemLock resources are available on the ChemLock webpages.

The Paperwork Reduction Act (PRA) requires federal agencies to take specific actions before requiring or requesting information from the public. This includes posting notices informing the public about new programs and policies and seeking comments from the public through information collection requests (ICR), which are published in the Federal Register. The Office of Management and Budget (OMB) manages this requirement and grants approval for requests of information.

Current ICR Will Expire 8/31/2025

  • Complete information collection package and Notice of Action (Ref. No. 202107-1670-001) issued by OMB to the Department authorizing the revised collection of information under OMB Information Collection 1670-0014. Issued on August 17, 2022.
  • Correction to previously published corrective notice (86 FR 40866). Due to a technical error that resulted in ICR 1670-0014 being unavailable for comment, CISA published another notice that extends the open comment period for an additional 30 days. Published on July 29, 2021.
  • Correction to previously published 30-day notice (86 FR 34267). In this notice, CISA corrected the instructions on how to submit comments, the length of time the comment period would be open, the number of comments received for the 60-day Federal Register notice, and the phone number for the point of contact. Published on June 29, 2021.
  • 30-Day Notice (86 FR 32953) to solicit public comments for a revision to OMB Information Collection 1670-0014 that supports several efforts under the CFATS program, such as redeterminations, compliance assistance, and verifying information submitted on Top-Screens (i.e., sale of a facility or removal of COI), among others. Published on June 23, 2021.
  • 60-Day Notice (86 FR 15490) to solicit public comments for a revision to OMB Information Collection 1670-0014. Published on March 23, 2021.
