Chemical Facility Anti-Terrorism Standards (CFATS) Personnel Surety Program (PSP) Information Collection 1670-0029

CFATS Announcement

As of July 28, 2023, Congress has allowed the statutory authority for the Chemical Facility Anti-Terrorism Standards (CFATS) program (6 CFR Part 27) to expire.

This means that CISA cannot enforce compliance with the CFATS regulations at this time. This includes the collection of information related to the CFATS regulation. Therefore, CISA is currently not collecting information under the CFATS PSP Information Collection, OMB Control Number 1670-0029. The Paperwork Reduction Act (PRA) requires federal agencies to take specific actions before requiring or requesting information from the public. This includes posting notices informing the public about new programs and policies and seeking comments from the public through information collection requests (ICR), which are published in the Federal Register. The Office of Management and Budget (OMB) manages this requirement and grants approval for requests of information.

These are the Federal Register notices and ICRs regarding the Chemical Facility Anti-Terrorism Standards (CFATS) Personnel Surety Program (PSP) Information Collection 1670-0029.

  • 30-Day Notice (87 FR 8026) to solicit public comments for a revision to OMB Information Collection 1670-0029 that supports continued routine information collection activities related to screening affected individuals for terrorist ties, which is implemented through the CFATS Personnel Surety Program (PSP). Published on February 11, 2022.
  • 60-Day Notice (86 FR 32960) to solicit public comments for a revision to OMB Information Collection 1670-0029 that supports continued routine information collection activities related to screening affected individuals for terrorist ties, which is implemented through the CFATS Personnel Surety Program (PSP). Published on June 23, 2021.

  • Complete information collection package and Notice of Action (Ref. No. 201806-1670-001) issued by OMB to the Agency authorizing the collection of information for the phased implementation of the CFATS Personnel Surety Program at all high-risk chemical facilities. Issued on May 23, 2019.
  • 30-Day Notice (83 FR 28244) to solicit comments for a revision to OMB Information Collection 1670-0029. This information collection will allow high-risk chemical facilities to implement the CFATS Personnel Surety Program on Tier 3 and 4 facilities. Published June 18, 2018.
  • 60-Day Notice (82 FR 61312) to solicit comments for a revision to OMB Information Collection 1670-0029. This information collection request notice is the first step in the process of gaining approval to allow high-risk chemical facilities to implement the CFATS Personnel Surety Program on Tier 3 and 4 facilities. In addition, this ICR notice revised the estimated number of annual respondents and the estimated time per respondent based upon historical data collected by the Department. Published December 27, 2017.

  • 30-Day Notice (79 FR 6417) to solicit comments for OMB Information Collection 1670-NEW (CFATS Personnel Surety Program). This information collection will allow high-risk chemical facilities to comply with 6 CFR 27.230(a)(12)(iv) to implement "measures designed to identify people with terrorist ties." Published February 3, 2014.
  • 60-Day Notice (78 FR 17680) to solicit comments for OMB Information Collection 1670-NEW (CFATS Personnel Surety Program). Under this notice, the Department revised its previously proposed collection of information to allow high-risk chemical facilities to comply with 6 CFR 27.230(a)(12)(iv) to implement "measures designed to identify people with terrorist ties." Published March 22, 2013.

  • Complete information collection package and Notice of Action (Ref. No. 201105-1670-002) issued by OMB acknowledging the withdrawal if the collection of information. Issued on July 20, 2012.
  • Paperwork Reduction Act (PRA) Notice (76 FR 34720) that (a) responds to comments received during the PRA 30-day comment period, and (b) notifies the public that the Office of Management and Budget is beginning its review of the PRA Information Collection Request for the CFATS Personnel Surety Program.
  • 30-Day Notice (75 FR 18850) to solicit comments for OMB Information Collection 1670-NEW (CFATS Personnel Surety). This information collection will allow high-risk chemical facilities to comply with 6 CFR 27.230(a)(12)(iv) to implement "measures designed to identify people with terrorist ties." The 30-day notice also responds to comments received during the 60-day comment period. Published April 13, 2010.
  • 60-Day Notice (74 FR 27555) to solicit comments for OMB Information Collection 1670-NEW (CFATS Personnel Surety). This information collection will allow high-risk chemical facilities to comply with 6 CFR 27.230(a)(12)(iv) to implement "measures designed to identify people with terrorist ties." Published June 10, 2009.
